According to police, this fatal Henderson pedestrian accident occurred on August 1 at approximately 5:30 p.m. at the intersection of Sunset Road at Marks Street. Stephonne Jerald Baker, of Las Vegas was crossing Sunset Road at Marks Street. He was apparently in the crosswalk but was crossing against the light. He was hit by 20-year-old Kristina Intinarelli as he made his way across the street. He landed on the windshield and rolled over the top of the vehicle before landing on the street. He passed away the next morning. Ms. Intinarelli remained on the scene and provided blood samples for testing. Police do not suspect that alcohol played a role in the incident.
First, we'd like to extend our condolences to the family and friends of Mr. Baker. To lose a life at 19 is truly tragic, and we hope those close to him are somehow able to overcome the grief and sorrow they are experiencing. Secondly, this Henderson pedestrian accident will only add to the overall statistics in regards to Nevada pedestrian accidents. Every year, approximately 50 people are killed in these incidents.
If the family of Mr. Baker decides to look into the possibility of filing a Nevada wrongful death lawsuit, the question of whether to do so would center on whether Mr. Baker was more or less negligent than the driver in this situation. Nevada follows what's known as a '51% Rule', which means that a plaintiff can recover damages as long as he or she is not more than 50% at fault for the result of the incident.
