For several years now, different jurisdictions around the United States have been seemingly taking turns banning the practice of using cell phones and other hand-held devices while behind the wheel without a hands-free device. The reason for these bans is obvious - they have proven to be a distraction that greatly increases the chance that an accident will occur. Nevada drivers are now being told in a new campaign that they need to take heed, as this practice is about to become illegal here too in hopes that this law will reduce the number of Nevada car accidents.
Specifically, this ban will take effect on October 1st of this year, but between October 1st and January 1st drivers will simply be issued a warning if they are pulled over. After the turn of the new year, however, drivers will be issued a $50 fine for a first offense, a $100 fine for a second offense within a seven-year period along with a points deduction and a $250 fine and possibly a six-month driver's license suspension for a third offense within seven years.
We hope that this new law improves the overall safety for drivers on the roads in Nevada, as we encourage any efforts that are made that help to keep drivers and passengers safe. Time will tell if this new law has an effect on the statistics regarding Nevada car accidents. Every year, thousands of people are injured in these crashes across the state and nearly 400 people are killed.
Despite the fact that using a cell phone while behind the wheel is technically not illegal at this point, that does not mean that someone cannot be found negligent and therefore liable for damages if a driver who is distracted in this manner causes a Nevada car accident that leads to injuries. If that occurs, it's possible for an injured person to file a Nevada personal injury lawsuit and recover damages that compensate the plaintiff for medical costs, lost income and pain and suffering.
If you or someone you love has been harmed by a distracted driver, you need to seek the help of Nevada car accident lawyers who have been fighting for the rights of the injured for many years. Contact Jack Bernstein & Associates today to schedule a free initial consultation.
