The accident occurred at approximately 6 p.m. at Sands Avenue just south of Wynn Las Vegas. Apparently, the woman was crossing the street and was outside the crosswalk when she was hit by a Dodge Ram truck. She was almost immediately struck again by a white SUV. The truck remained on the scene and the driver will not face charges. However, the SUV fled the scene after stopping briefly and police are actively searching for the driver.
First, we'd like to extend our most heartfelt condolences to the family of the woman who was killed. She was only 35 years old, and this sort of shock will be difficult to endure and to overcome. Our firm has helped countless people through these terrible times and we hope that those who are left behind find some sort of peace soon.
One of the layers of legal analysis that this Las Vegas pedestrian accident entails is the concept of comparative negligence. Clearly, the woman was somewhat negligent by not using the crosswalk. What has yet to be determined is if the driver of the Dodge Ram truck was also negligent during the seconds before the crash occurred. These sorts of questions come down to the jury if a Nevada wrongful death lawsuit is filed by the family of the woman who was killed.
In addition to the question of comparative negligence, there could be other issues that arise with the driver who fled the scene. Nevada law is very clear in these situations, stating:
3. A person failing to comply with the provisions of subsection 1 is guilty of a category B felony and shall be punished by imprisonment in the state prison for a minimum term of not less than 2 years and a maximum term of not more than 15 years and by a fine of not less than $2,000 nor more than $5,000.
