According to reports, a man was crossing East Flamingo Road west of South El Oro Street in eastern Las Vegas. He was crossing from the north to the south and was apparently outside the crosswalk. He was hit by a 2004 Hyundai Elantra being driven by 71-year-old Las Vegas native driven by Kenneth Kimak. The accident occurred just before 12:30 a.m., and the man who was hit was pronounced dead at Sunrise Hospital. His name will not be released until family members can be notified of the situation.
First and foremost, our deepest sympathies go out to the man who was suddenly killed while crossing the street. Unexpected and shocking losses like this one are always extremely difficult for surviving family members to overcome, and we hope that the family is able to somehow work through what will certainly be a difficult time for them.
If the family decides to bring a Nevada personal injury lawsuit to court, the claim would be made under a theory of wrongful death. However, since the man who was killed was not using the crosswalk, he was also partially negligent in this situation. Nevada uses a modified form of comparative fault, whereby a plaintiff can still recover damages in court as long as he or she was less than 51 percent at fault.
