According to authorities, the latest Las Vegas pedestrian accident occurred on Sunday just before 8 p.m. when an unidentified 29-year-old man and Las Vegas resident was attempting to cross Nellis Boulevard at Desert Inn Road. As he was doing so, and apparently outside the crosswalk, he was hit by the driver of a 1996 Honda Civic. The driver and the passenger then fled the scene on foot, and as it turns out the vehicle had been stolen earlier in the day. The man who was hit was transported to a nearby hospital with serious injuries.
First and foremost, we'd like to offer our hope that the man who was hit is able to recover from the harm he has suffered, and we also hope that the driver in this Las Vegas hit-and-run accident is ultimately identified and apprehended. In addition, this Las Vegas pedestrian accident will now become part of the overall statistics regarding Nevada pedestrian accidents. Every year, nearly one person every week is killed in these crashes.
In order to provide sound legal analysis of this situation, more facts would be necessary. If the pedestrian was not using the crosswalk, it could lead to an application of Nevada's comparative negligence standard if a Nevada personal injury lawsuit was filed. If this situation proceeded in that manner, the man's damages recovery would be reduced by the percentage of fault the court assigned to him, but would not preclude him from bringing a claim depending on specific circumstances that are not known at this time.
If you or someone you love has been harmed by a reckless driver, you need to seek the help of Las Vegas personal injury attorneys who have been successfully defending the rights of those injured for many years. Contact Jack Bernstein & Associates today to schedule a free initial consultation.
