We've been following a tragic story recently regarding a woman who was killed in a traffic accident. The driver of the vehicle who caused the deadly collision is suspected of DUI, and now comes word that he pleaded not guilty to a charge of felony drunken driving . In response to the plea, the judge allowed for bail to be set at $25,000.00
According to Fox 5 News in Las Vegas :
"A judge set bail at $25,000 Wednesday for a teenager who police said was drunk when he ran a red light and collided with a young woman’s car.
Kevin Miranda, 18, pleaded not guilty to charges of felony drunken driving and is due back in court in February.
Miranda was arrested Nov. 29, after his truck collided with a car driven by 24-year-old Angela Peterson at the intersection of Rainbow Boulevard and Flamingo Road.
An arrest report noted Miranda admitted drinking four shots of Jack Daniels before the accident.Police said he had a blood-alcohol level of 0.142 percent, nearly double the legal limit of 0.08 percent, and failed a number of field sobriety tests at the scene."
When bail is granted, it does not by any means stop the wheels of justice from turning, and that won't happen for this defendant. However, almost regardless of how a criminal prosecution proceeds, incidents like this can give rise to civil liability that can be sought by the family of the deceased.
