Sadly, such a drug was the center of a recent Nevada defective drugs lawsuit in which three female plaintiffs were awarded a total of $58 million in damages. The women had been taking a drug known as Prempro, which was used as a hormone replacement. Tragically, all three of them contracted breast cancer after using the drug that is manufactured by Wyeth, which is now part of Pfizer.
After the trial was completed, the jury came back with a damages award of $134.5 million. However, the judge voided the $99 million of these damages that was designated as punitive damages and instructed the jury to reconsider that portion of the damages. Ultimately, the jury returned with a total judgment of $58 million against Wyeth. Not surprisingly, the drug company is appealing on several grounds, including:
Basically, the appeal of this sort of verdict should be seen as commonplace. Two of the original plaintiffs in the case have since died, but that does not mean that their estates cannot collect the damages.
