On February 15, 2008, while a pedestrian walking across a Las Vegas
street at a cross walk after getting a cup of coffee during his work
break, John Doe was violently struck by a negligent driver. The impact
hurled him into the air and against the hood of the car before he
toppled to the pavement. As a result, he suffered severe injuries to
his neck and knee. This avoidable accident occurred for one reason: The
driver was intoxicated. The driver was drunk and should not have been
behind the wheel.

Ralph Aguado, had recently moved into a multiunit rental community. On
a December evening, while walking towards the parking lot, Aguado
