According to police, a pedestrian has been seriously injured in a crash involving a pickup truck on Boulder Highway. Officer Larry Hadfield reports that a female pedestrian was hit by a pickup truck around 3:00 p.m., just north of U.S. 95. The driver remained at the scene and cooperated with police. The pedestrian was transported to Sunrise Hospital & Medical Center. Police will continue to investigate the crash.

Pedestrian Rights After a Crash

According to statistics from the National Highway Traffic Safety Administration, more than 76,000 pedestrians were injured and another 4,743 were killed in traffic crashes in 2013. When any type of traffic crash occurs, it is important to determine who was at fault. In many cases involving pedestrians, the driver is considered at fault. It is important to remember that drivers have a responsibility to be aware and obey traffic laws to help them avoid a collision. This means that if a driver is speeding or not paying attention and hits a pedestrian, the driver may be responsible for the victim's injuries, even if the pedestrian was not in a crosswalk. When a driver is acting in a negligent manner, such as texting or drinking and driving, and hits a pedestrian, the victim may have a right to bring a personal injury lawsuit against the driver. This type of lawsuit will allow the victim to seek compensation for:
  • Medical expenses, both past and future including emergency services and rehabilitation
  • Lost wages, during recovery and if the victim is unable to work due to their injuries
  • Pain and suffering
  • Loss of enjoyment of life
Compensation for the injured person is meant to make the victim “whole.” While no amount of money can heal a pedestrian, it can cover medical expenses, therapy and help compensate him or her for permanent changes in life such as the loss of ability to take care of oneself or to work.
