Pedestrian Killed in Crash Identified

A pedestrian killed on Boulder Highway has been identified by the Clark County Coroner’s office as Richard Eubanks, 62, of Las Vegas, according to recent reports. Eubanks was hit by a 2003 Volkswagen Jetta while he attempted to cross Boulder Highway north of Sunset Road. According to Henderson spokeswoman Kathleen Richards, Eubanks was not in a crosswalk when he was hit in the left travel lane. The driver of the Jetta is a 19-year-old who was not injured. Authorities say that alcohol and drugs do not appear to be factors in the accident. The coroner’s office has ruled Eubanks’ death an accident. This was the first traffic-related fatality in Henderson’s jurisdiction in the New Year.

Road Dangers to Pedestrians

According to statistics, 33,561 people were killed in 2012 in traffic accidents across the US, and over 2 million injured. Approximately 14 percent of these fatalities were pedestrians. Statistics show that over 70 percent of pedestrian fatalities occurred at non-intersections versus intersections, so pedestrians who do not use crosswalks are at far greater danger of being struck by a vehicle. However, when a pedestrian is hit by a car, the driver of the car is usually considered to be at fault, even if the pedestrian was not in a crosswalk. This is because many states recognize that drivers should be alert to what is going on around them and avoid hazards that are in the road. Drivers are expected to take the lead in avoiding pedestrian accidents, even if the pedestrian is not following traffic rules. In some cases, vehicle-pedestrian accidents can be caused by faulty traffic control devices, improper signage or poorly constructed crosswalk/streets. In these cases, the fault would likely lie with the city or other agency that placed the traffic light or signage.
