Child In Critical Condition After Being Hit By a Car

Deyaveon Jackson, 12, was playing with friends when she was hit by a car Sunday afternoon. According to police, Deyaveon was playing near North Nellis Boulevard and East Owens Avenue when she accidentally stepped into the street and was hit.

Deyaveon's mother, Catherine Mayers, stated that her daughter was being chased by another child when she stepped into the road and was hit. Deyaveon is currently in the hospital suffering from a fractured pelvis and broken femur, tibia and wrist. She also has swelling of the brain. She has been unresponsive since the accident.

Mayers stated that Deyaveon has been unresponsive but had opened her eyes since being taken off sedation medication. It is unclear at this point whether she will be able to recover from her injuries. The driver remained at the scene and police say he is not facing charges.

Vehicle Accidents, Children, and Personal Injury Claims

Sadly, many children are injured and killed each year in traffic accidents. When a child is hit by a car, the parents can seek compensation in an injury claim. However, there are special rules for compensation and liability when children are involved.

The law does not expect the same standard of care from children as from adults. Thus, the law may determine that a child is not responsible for an accident because he or she did not understand the danger of running into a street, for example.

A child cannot negotiate a personal injury settlement alone. The law allows a parent or guardian, who is approved by a judge, to negotiate and settle on behalf of the child. If the insurance company refuses to settle, the parents can take the company to court on behalf of the child.

The same type of damages apply in a personal injury case involving a child as they do in cases involving an adult.
