An elderly woman was struck and injured while crossing the street on the west side of the Las Vegas Valley. Police reported that the 81-year-old woman was struck when she was crossing Rainbow Boulevard from west to east north of Twain Avenue.

They have confirmed that she was outside of the crosswalk when struck. The woman suffered critical injuries and was transported to UMC Trauma. She remains unconscious. Traffic was halted for a little more than three hours following the accident.

Pedestrian Accident Risks

According to statistics from the National Highway Traffic Safety Administration (NHTSA), 2012 saw 4,743 pedestrian fatalities across the US. Statistics also reveal that 70 percent of fatal pedestrian crashes occur outside an intersection. In addition, 70 percent of all pedestrian crashes occur at night. The largest single group of victims, comprising 20 percent of total pedestrian fatalities, were individuals aged 65 and over.

Can Pedestrians Seek Compensation for Damages in a Personal Injury Case?

Pedestrians, like other motorists, have rights under civil law to seek compensation for damages if they were injured in an accident. Drivers are required to maintain a certain level of awareness when driving on the road. This awareness allows them to see obstructions in the road and avoid them. That means that drivers are often held responsible for hitting a pedestrian, even if the pedestrian is not in the crosswalk.

When pedestrians are hit, it is usually because the driver failed to see them. Sometimes this is because the driver was not paying attention or was going too fast to stop in time. No matter what the reason for the crash, it is important for pedestrians to collect compensation for their injuries, particularly if they face high medical bills.

Insurance companies are not in the business of helping victims. Instead, they are for-profit entities who work to minimize the amount they have to pay out, even if the individual has been wrongfully injured. Negotiating directly with an insurance company may not result in the compensation that you need to pay your bills.
