Las Vegas Wrongful Death Lawyers

Fight for Justice After the Loss of a Loved One

Losing someone suddenly is difficult, but losing someone because another person acted in a negligent or reckless manner is incredibly challenging.

The Las Vegas wrongful death attorneys at Bernstein & Poisson have been representing grieving and struggling families who were forced into this extremely difficult position for over 60 years. We have always been taken aback by the tragedy of these situations, and in many cases inspired by the ability of these families to come together and work through this dark and confusing time in a way that’s healthy, constructive, and conducive to healing for everyone involved. We make sure to apply that same type of focus and approach towards every wrongful death case that we handle because we owe that to the people we serve.

As inspiring as it is to see family members rally around each other, that doesn’t mean that they should handle the legal aftermath of a sudden, wrongful death by themselves. They will still eventually run into insurance adjusters and/or defense attorneys who may approach them with respect and dignity but who do not work for that family’s best interest and who will work to minimize the financial exposure of their clients and/or employers. That’s simply how the legal world works, and grieving families without any legal background are frankly not in a position to deal with these situations properly.

What Is a Wrongful Death Claim?

A wrongful death lawsuit is brought by certain survivors of a victim who has lost his or her life due to the deliberate or carelessly negligent actions of another person. While many wrongful death lawsuits are filed after accidents, some are filed after a criminal action has been brought against an individual. For example, in some cases, those who are acquitted of murder or manslaughter based on technicalities in the criminal legal system may still be subject to wrongful death lawsuits.

Unlike a criminal case, a wrongful death lawsuit uses a different standard of proof. In order to be convicted of murder or manslaughter, a defendant must be proven guilty beyond a reasonable doubt. In order to win a wrongful death lawsuit, a jury must only find that the defendant was responsible for the death by a preponderance (majority) of the evidence.

A wrongful death claim can arise from of a number of circumstances, including:

  • Medical malpractice that resulted in death
  • Automobile accident
  • Airplane accident
  • Occupational exposure to hazardous conditions or substances
  • Death during a supervised activity

Damages Awarded in a Wrongful Death Lawsuit

Some of the damages you can seek in a wrongful death suit are similar to those in a personal injury suit. However, there are a few unique damages that you can only seek in a wrongful death suit -- like funeral and burial costs.

Damages in a wrongful death action may include:

  • Medical bills incurred from the moment of the accident to death
  • Conscious pain and suffering of the victim before death
  • Other expenses incurred prior to the victim's death
  • Funeral and burial expenses
  • Loss of companionship
  • Loss of income and benefits
  • Punitive damages, in some cases

If you have lost a loved one due to the negligence or misconduct of another person, you may be entitled to bring a wrongful death suit against those responsible.

Who Can Bring a Wrongful Death Lawsuit in Nevada?

A wrongful death lawsuit cannot be filed by just anyone. According to state law, only certain members of decedent’s family, or those who have an interest in the case, may bring a wrongful death lawsuit. In Nevada, only the following persons can file a wrongful death claim:

  • Personal representative of the deceased’s estate
  • Surviving spouse or domestic partner
  • Child
  • Parent

This prevents uninterested parties from bringing these suits solely for financial gain.

5 / 5 stars
"Bernstein personally was involved in my case and got a quick settlement for a fall and death case involving a family member."

We like to resolve these situations quickly if a fair compromise can be reached, as this allows the family to put the situation in the past sooner. Unfortunately, that is not always possible, due to the extremely serious nature of these cases. Families lose out on what could be decades of income, on a lifetime of companionship, and on generations of the enjoyment of life. All of that needs to be accounted for, and if that means that we need to go to trial in order to get the result that you deserve, then that’s exactly what we’re going to do without hesitation.
