DRUNK DRIVING ACCIDENT LAWYERS IN LAS VEGAS
WE’VE RECOVERED MILLIONS IN SETTLEMENTS & VERDICTS FOR THE INJURED
By now, after decades of seemingly relentless efforts by lawmakers and law enforcement to bring awareness to the extreme dangers of drunk driving, there really is no excuse for engaging in this conduct. Not only should everyone understand that drunk driving is dangerous, but they should also understand that the criminal penalties for driving under the influence of drugs or alcohol are significant. Drunk driving is a scourge on society and it is something that will continue to dominate the headlines until everyone finally understands that it needs to stop.
We need to be able to extend at least a modicum of trust that these other motorists will do the right thing and follow traffic laws, for if we don’t we will likely become too defensive behind the wheel and invite risks in some other way. Examples of assumptions that we make with regards to other motorists include:
- That driver will not cut me off
- That driver will not collide with my rear bumper
- That driver will stop for that red light
- That driver is not under the influence of alcohol or some other intoxicant
Unfortunately, many of these assumptions turn out to be incorrect and people are badly injured or worse as a result. At Bernstein & Poisson, we believe in holding drunk drivers accountable.

DUI INJURY ACCIDENTS VS. TYPICAL INJURY ACCIDENTS
While the number of drunk driving injuries and fatalities have been dropping slightly in recent years, they are still extremely troubling statistics. To make matters worse, the aftermath of a drunk driving accident can be very confusing for anyone who has been injured or for any family that has suddenly lost a loved one. That’s because law enforcement is almost always involved, and when the drunk driver faces criminal sanctions, too many people feel that their only outlet for recovery of compensation lies with the insurance company or companies that are involved.
This is a mistake. People who have been injured and family members of people who have been killed in crashes caused by drunk drivers have the same basic legal rights under Nevada’s personal injury laws as people who were injured in crashes caused by drivers who had not been drinking. In fact, people injured by drunk drivers often have a strong case simply because they can prove that the other person had consumed alcohol before the crash and that the presence of alcohol in that driver’s system played a part in what ultimately occurred.
When we take on a drunk driving accident case in Las Vegas, our attorneys fight for economic and non-economic damages, including:
- Medical expenses, including ongoing treatment and care
- Loss of earnings, including loss of future earnings
- Emotional trauma, such as pain and suffering or loss of companionship
- Property damage, to your vehicle or other personal property
TRUCK DRIVERS & DRIVING UNDER THE INFLUENCE
Did you know that specific drivers on the road are held to a higher standard of care? These include truck drivers, bus drivers and other professional drivers who have a commercial driver’s license (CDL). These professional drivers must adhere to the strict rules established by the Federal Motor Carrier Safety Administration (FMCSA). One reason these drivers are held to a higher standard of care is the risks are much higher for victims in accidents caused by larger vehicles than smaller vehicles. Someone who is driving drunk in a commercial vehicle not only poses a serious risk to themselves but to the public at large. The driver also exposes his or her employer to liability.
Most states enforce the FMCSA regulations for commercial drivers and the consumption of alcohol. This means that the legal blood-alcohol concentration limit for a commercial truck driver is 0.04 percent, which is half the BAC limit for those who are non-commercial drivers. The FMCSA rules also state that commercial truck drivers are prohibited from operating a commercial vehicle within four hours of consuming alcohol.
PEDESTRIAN ACCIDENTS & DRIVING UNDER THE INFLUENCE
Pedestrians who drink are at particular risk of being injured in an accident. Alcohol slows reaction time and impairs judgment, making it more likely a pedestrian will engage in risky behavior such as crossing the street outside a crosswalk or against the light. However, even if a pedestrian is drinking, drivers still have a responsibility to avoid pedestrian crashes. When drivers drink, the risk of a serious or fatal pedestrian accident rises as well. Pedestrians are often struck by drunk drivers even when they are obeying traffic laws such as crossing with the light at a crosswalk.
Whether the pedestrian is obeying the law or not, however, drivers are still held at least partially responsible in most pedestrian crashes. While Nevada law does have exceptions to this rule, such as when a pedestrian “leaps” in front of a car, in general, the law holds drivers accountable for avoiding such crashes. If you have been the victim of a pedestrian accident, even if you were drinking or think you may be at fault, talk about your case to the experienced injury attorneys at Bernstein & Poisson in Las Vegas. We are here to help you recover compensation whenever possible, no matter what the circumstances of your accident.
