Jack’s Got Your Back
Las Vegas CityCenter Slip & Fall Accident Lawyers
Unlike a standard resort, CityCenter is not a single business; it is a massive 67-acre district with a tangled web of owners, operators, and insurance policies.
A fall at Aria involves MGM Resorts and Blackstone. A slip just steps away at The Shops at Crystals involves Simon Property Group and Invesco. An injury at Veer Towers might involve a residential HOA. Naming the wrong entity costs time and can cost the claim, especially if it is not caught before the two-year period runs out.
With 40+ years of experience, Jack Bernstein knows how to untangle this liability web. He knows exactly which security team holds your footage, which insurance policy applies to your fall, and how to hold the right corporate giant accountable.

What should I do immediately?
CityCenter is a jurisdiction maze. Evidence preservation is critical because each property has its own security team and retention protocols. In Nevada, you generally have two years after the cause of action accrues to file an injury lawsuit (NRS 11.190), though different deadlines and exceptions can apply, including that the period does not run while the injured person was under 18 or insane when the cause of action accrued (NRS 11.250). Surveillance footage is often deleted in 30 days or less.
- Aria/Vdara: Report to MGM Security.
- Shops at Crystals: Report to Crystals/Simon Security. Do not assume Aria security can help you here.
- Waldorf Astoria: Report to Hilton/Waldorf security.
- Veer towers: Report to the HOA/Concierge.
Understanding CityCenter’s liability zones
CityCenter looks like one cohesive destination, but legally, it is a collection of separately owned and operated properties.

Proving negligence: the four elements
To win a premises liability case in Nevada, we must prove four elements under Nevada common law rather than a statute, starting with the property owner’s duty to use reasonable care toward visitors (Foster v. Costco Wholesale Corp., 128 Nev. 773 (2012)).
- Example: A puddle of rainwater tracked into the Shops at Crystals entrance that blended into the polished stone floor.
- Example: If an Aria tram attendant watched passengers stumble over a platform gap for an hour without warning anyone, they had “constructive notice”.
- Example: Failing to place non-slip mats at the Vdara valet entrance during monsoon season.
- Example: The slick stone is what put you on the floor. If the resort argues you were also distracted, that is an argument about your share of the fault rather than an answer to this element, and under NRS 41.141 you can still recover as long as your negligence was not greater than the negligence of the defendant, or the combined negligence of the defendants you are suing, with any award reduced in proportion to your share.
Types of compensation available
An injury at CityCenter can be devastating, involving specialized medical care and complex recovery.
Economic damages (financial losses)
Medical bills
Lost wages
Travel disruption
Non-economic damages (quality of life)
Pain and suffering
Loss of enjoyment
Long-term impact
Note: Under Nevada’s comparative negligence law (NRS 41.141), you can recover damages even if you were partially at fault (e.g., wearing high heels), as long as your share of the fault is not greater than the combined fault of the parties you are suing, and your award is reduced by your share.
“Guest recovery” vs. legal liability
High-end properties like Aria and Waldorf Astoria pride themselves on service and will try to “recover” the guest experience immediately.

Frequently asked questions
Have questions about your case?
Every CityCenter slip & fall accident case is different. These answers cover the general rules; what applies to you depends on the facts.
Call us any time, 24 hours a day, and we will go through the specifics with you. It is free, and there is no obligation.
(702) 633-3333 Free consultation · Available 24/7 Or send us the details onlineCan I sue MGM if I fell at The Shops at Crystals?
Possibly not, and it is worth checking before anyone sues. The Shops at Crystals have been reported as owned by Simon Property Group and Invesco rather than MGM Resorts. The right defendant depends on who owned and controlled the area where you fell, which has to be verified rather than assumed, and more than one party may share responsibility. We confirm ownership and control first so the claim is directed at the parties actually answerable for that spot.
Who is responsible for the Aria Express tram?
The tram connects properties owned by different entities (Bellagio, Crystals, Aria/Park MGM). However, maintenance and operations are typically handled by MGM Resorts. We investigate the specific maintenance logs to determine liability for platform gaps or sudden stops.
Can I sue if I was drinking at the Vdara pool or Aria bars?
Yes. Both properties serve alcohol and expect guests to consume it. What a property owner owes a guest is reasonable care in the circumstances: inspecting for hazards, and fixing or warning about the ones it knew or should have known about. That obligation does not disappear because a guest has been drinking. Intoxication by itself does not bar your recovery: under NRS 41.141, recovery is barred only if your share of the fault is greater than the combined fault of the parties you are suing.
I fell at Veer Towers. Who do I sue?
Veer Towers is a residential condo complex. Liability usually falls on the HOA (managed by Associa Nevada South) for common areas like the lobby or elevators, or an individual unit owner if the injury occurred inside a private residence.
I live out of state. Can I still pursue a case?
Yes. We represent clients from all over the world, and we handle the Nevada end: the investigation, the filings, the court appearances and the dealings with the insurers. What you may still be asked to do in person, if the case is filed, is sit for a deposition, attend a medical examination by a doctor the defense selects, and appear at trial. We schedule around your travel wherever we can and tell you in advance what will need you there.
How long do I have to file a claim?
You generally have two years for an injury claim (NRS 11.190(4)(e)), but different deadlines and exceptions can apply, including that the period does not run while the injured person was under 18 or insane when the claim accrued (NRS 11.250), so you should contact an attorney immediately. With so many different security teams involved, surveillance footage can be lost in the shuffle or deleted within 30 days.
